  1                      A bill to be entitled

  2         An act relating to privacy; prohibiting retail

  3         establishments and their employees and agents

  4         from directly observing or using video cameras

  5         or other surveillance equipment to observe

  6         customers in dressing rooms, fitting rooms,

  7         changing rooms, or rest rooms; providing

  8         penalties; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  (1)  It is unlawful for any retail sales

13  establishment or any person employed by, or acting as an agent

14  of or on behalf of any person or entity contracting with, such

15  an establishment to directly observe or make use of video

16  cameras or other surveillance devices to observe or record

17  customers who are using the retail sales establishment's

18  dressing room, fitting room, changing room, or rest room.

19         (2)  Any person or entity who violates subsection (1)

20  is guilty of a misdemeanor of the first degree, punishable as

21  provided in section 775.082 or section 775.083, Florida

22  Statutes.

23         Section 2.  This act shall take effect July 1, 1999.

27    Makes it a first-degree misdemeanor for a retail
      establishment or its employees or agents to directly
28    observe or make use of video cameras or similar equipment
      to observe customers in dressing rooms, fitting rooms,
