18 Supplement, is amended to read:
19 230.23162 Residential public education facility.--
20 (1) Ownership of the facility and related assets
21 authorized under former s. 985.402, is transferred to the
22 Department of Management Services. The Department of
23 Management Services shall direct change orders in existing
24 construction contracts necessary to complete construction to
25 the extent necessary to stabilize assets and prepare the
26 facility for future utilization. The Department of Management
27 Services shall provide administrative, site inspection, and
28 security services as necessary to carry out the provisions of
29 this section. The Department of Management Services shall have
30 access to all state funds previously appropriated to the
31 Alternative Education Institute for this purpose.

1 (a) The Department of Management Services shall
2 continue to work with contractors to weatherize, close in, and
3 stabilize the facility, protect the assets, and resolve any
4 claims regarding the facility.
5 (b) The Department of Management Services should
6 continue to facilitate interest by private entities or public
7 entities capable of serving as either owner, occupant, or
8 fiscal agent for a public-private partnership. Any entity,
9 public, private, or a public-private partnership, must meet
10 all of the criteria specified in the revised Department of
11 Management Services Request for Proposal dated August 21,
12 1998, and issued pursuant to chapter 98-209, Laws of Florida.
13 (2) The Department of Management Services, in
14 cooperation with the relevant state agencies, is directed to
15 continue to receive and evaluate proposals for the use or
16 transfer of the facility described in subsection (1) and,
17 after taking into account local and state concerns and
18 interests, may make a final disposition for use or transfer of
19 such facility, subject to the notice, review, and objection
20 procedures of s. 216.177. Any unexpended balance of funds
21 appropriated from Specific Appropriation 2012A of chapter
22 94-357, Laws of Florida, remaining after dry-in and
23 stabilization may be expended, consistent with the provisions
24 of this section, for completion of the facility in connection
25 with the disposition or transfer of the facility.
26 (a) The Department of Management Services shall
27 continue to invite public-agency proposals and related funding
28 requests, from either state or local agencies, to provide an
29 education program for nonadjudicated youth, and also to
30 continue to encourage other proposals and funding requests
31 consistent with state and local community needs and concerns.

1 (b) Upon request, the Department of Management
2 Services shall continue to work with project proposers who
3 submitted proposals, and an addendum to proposals, to the
4 working group pursuant to chapter 98-209, Laws of Florida.
5 (c) In considering proposals, the Department of
6 Management Services and the Legislature shall take into
7 account local and state interests and concerns.
8 (2)(a) A working group is formed to develop a plan for
9 the use of the facility and to develop a request for proposals
10 or request for information for operation of the program by a
11 private contractor. The working group shall be composed of
12 eight members: one member each from the Department of
13 Education, Department of Juvenile Justice, and Department of
14 Children and Family Services; one member appointed by the
15 President of the Senate; one member appointed by the Speaker
16 of the House of Representatives; one representative of the
17 13th judicial circuit of Hillsborough County, to be appointed
18 by the Chief Circuit Judge; one representative of the
19 Hillsborough School District, and one representative from
20 local law enforcement to be appointed by the Sheriff of
21 Hillsborough County. The Department of Education shall provide
22 administrative support for the working group.
23 (b) The group shall assess needs of categories of
24 clients served by the member agencies in evaluating possible
25 uses for the facility in meeting the needs of the clients. The
26 group shall identify client categories that may be served
27 through the use of the facility, shall outline a program
28 structure, and shall make further recommendations, including a
29 proposed private provider for implementation. The group should
30 consider previous recommendations for use of the facility, and
31 shall specifically consider the viability of prior proposals

1 submitted for use of the facility in the fiscal year
2 1997-1998. The group shall be formed and activated when this
3 act becomes law.
4 (3) The Department of Management Services shall survey
5 state agencies, and shall invite bids and proposals from state
6 agencies, local government agencies, federal agencies, and the
7 private sector for the use or disposition of the facility and
8 related assets, no later than June 15, 1998. Notwithstanding
9 any law to the contrary, the Department of Management Services
10 shall set a deadline for receipt of bids and proposals of not
11 less than 3 months after the invitation for bids and proposals
12 is advertised. By October 1, 1998, the Department of
13 Management Services shall evaluate all bids and proposals and
14 make a recommendation to the working group created under this
15 section regarding proposed uses for the facility, taking into
16 account local and state interests and concerns.
17 (4) Taking into consideration the recommendation of
18 the Department of Management Services, and local and state
19 concerns and interests, the working group shall, no later than
20 November 1, 1998, make a final determination for the use or
21 disposition of the facility and related assets planned,
22 constructed, acquired, and equipped pursuant to Specific
23 Appropriation 2012A of the 1994-1995 General Appropriations
24 Act, and shall be disbanded upon that date. Such
25 determination shall be subject to the notice, review, and
26 objection procedures of s. 216.177. If the final determination
27 made by the working group is objected to under s. 216.177, the
28 final determination for the facility and related assets shall
29 be made by the Legislature during the 1999 Regular Session.
