  1                      A bill to be entitled

  2         An act relating to the long-term care community

  3         diversion pilot projects; amending s. 430.703,

  4         F.S.; defining "other qualified provider";

  5         amending s. 430.707, F.S.; authorizing the

  6         Department of Elderly Affairs to contract with

  7         other qualified providers to provide long-term

  8         care within the pilot projects; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Subsection (7) of section 430.703, Florida

14  Statutes, is renumbered as subsection (8), and a new

15  subsection (7) is added to said section to read:

16         430.703  Definitions.--As used in this act, the term:

17         (7)  "Other qualified provider" means an entity

18  licensed under chapter 400 that meets all the financial and

19  quality assurance requirements for a provider service network

20  as specified in s. 409.912, is exempt from chapter 641, and

21  can demonstrate a long-term care continuum.

22         Section 2.  Subsection (1) of section 430.707, Florida

23  Statutes, 1998 Supplement, is amended to read:

24         430.707  Contracts.--

25         (1)  The department, in consultation with the agency,

26  shall select and contract with managed care organizations, and

27  with other qualified providers using the capitation

28  rate-setting method established under s. 430.704, to provide

29  long-term care within community diversion pilot project areas.

30         Section 3.  This act shall take effect upon becoming a

31  law.
