  2         An act relating to transportation; amending s.

  3         334.044, F.S.; providing for the allocation of

  4         a certain percentage of road projects for

  5         roadside beautification by the Department of

  6         Transportation; providing for administration;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (26) of section 334.044, Florida

12  Statutes, 1998 Supplement, is amended to read:

13         334.044  Department; powers and duties.--The department

14  shall have the following general powers and duties:

15         (26)  To provide for the conservation of natural

16  roadside growth and scenery and for the implementation and

17  maintenance of roadside beautification programs. To accomplish

18  this, the department shall allocate no less than 2 percent of

19  its total project budget to beautification; no less than 1

20  percent will be spent on existing roads and no less than 1

21  percent on new road construction. Only large plant materials

22  purchased from Florida-based nurserymen stock on a competitive

23  bid basis will be used. This program will be administered by

24  Keep Florida Beautiful, Incorporated. To accomplish these

25  activities, the department may contract with nonprofit

26  organizations having the primary purpose of developing youth

27  employment opportunities.

28         Section 2.  This act shall take effect July 1, 1999.
