17 Section 1. Subsection (23) of section 163.503, Florida
18 Statutes, 1998 Supplement, is amended to read:
19 163.340 Definitions.--The following terms, wherever
20 used or referred to in this part, have the following meanings:
21 (23) "Community policing innovation" means a policing
22 technique or strategy designed to reduce crime by reducing
23 opportunities for, and increasing the perceived risks of
24 engaging in, criminal activity through visible presence of
25 police in the community, including, but not limited to,
26 community mobilization, neighborhood block watch, citizen
27 patrol, university police patrol, as defined in s.
28 163.503(10), citizen contact patrol, foot patrol, neighborhood
29 storefront police stations, field interrogation, or
30 intensified motorized patrol.

1 Statutes, 1998 Supplement, is amended and a new subsection
2 (10) is added to that section, to read:
3 163.503 Safe neighborhoods; definitions.--
4 (1) "Safe neighborhood improvement district,"
5 "district," or "neighborhood improvement district" means a
6 district located in an area in which more than 75 percent of
7 the land is used for residential purposes, or in an area in
8 which more than 75 percent of the land is used for commercial,
9 office, business, postsecondary education, or industrial
10 purposes, excluding the land area used for public facilities,
11 and where there is a plan to reduce crime through the
12 implementation of crime prevention through environmental
13 design, environmental security, or defensible space
14 techniques, or through community policing innovations or the
15 use of a university police patrol. Nothing in this section
16 shall preclude the inclusion of public land in a neighborhood
17 improvement district although the amount of land used for
18 public facilities is excluded from the land use acreage
19 calculations.
20 (10) "University police patrol" means one that
21 services a safe neighborhood district that is coterminous with
22 the campus boundaries of a nonpublic college or university
23 with an enrollment of more than 10,000 full-time students
24 within the district boundaries and is funded by the
25 institution or otherwise, as authorized by law.
26 Section 3. Section 163.5035, Florida Statutes, is
27 amended to read:
28 163.5035 Safe neighborhood improvement districts;
29 compliance with special district provisions.--Any special
30 district created pursuant to this part shall comply with all
31 applicable provisions contained in chapter 189. In cases

1 where a provision contained in this part conflicts with a
2 provision in chapter 189, the provision in chapter 189 shall
3 prevail. However, notwithstanding any provision in this
4 chapter or chapter 189, a university police patrol, as defined
5 in s. 163.503, created by a safe neighborhood improvement
6 district, may exercise law enforcement powers within the
7 district.
8 Section 4. Subsection (3) of section 163.506, Florida
9 Statutes, 1998 Supplement, is amended and a new subsection (5)
10 is added to that section to read:
11 163.506 Local government neighborhood improvement
12 districts; creation; advisory council; dissolution.--
13 (3) As an alternative to designating the local
14 governing body as the board of directors, a majority of the
15 local governing body of a city or county may appoint a board
16 of three to seven directors for the district who shall be
17 residents of the proposed area and who are subject to ad
18 valorem taxation in the residential neighborhood improvement
19 district or who are property owners in a commercial
20 neighborhood improvement district. The directors shall be
21 appointed for staggered terms of 3 years. The initial
22 appointments shall be as follows: one director for a 1-year
23 term; one director for a 2-year term; and one director for a
24 3-year term. If more than three directors are to be appointed,
25 the additional members shall initially be appointed for 3-year
26 terms. Vacancies shall be filled for the unexpired portion of
27 a term in the same manner as the initial appointments were
28 made. Each director shall hold office until his or her
29 successor is appointed and qualified unless the director
30 ceases to be qualified or is removed from office. Upon
31 appointment and qualification and in January of each year, the

1 directors shall organize by electing from their number a chair
2 and a secretary. The board of directors of a district that has
3 a university police patrol has the qualifications in the
4 ordinance that creates the district.
5 (5) Members of a university police patrol are law
6 enforcement officers with arrest powers and may bear arms.
7 They must meet the standards adopted by the Criminal Justice
8 Standards and Training Commission and be certified as law
9 enforcement officers. Those who are police officers are
10 district employees.
11 Section 5. Subsection (5) is added to section
12 163.5151, Florida Statutes, to read:
13 163.5151 Fiscal management; budget preparation.--
14 (5) Notwithstanding any provision of this section,
15 budget and fiscal matters of a safe neighborhood district that
16 has a university police patrol may be prescribed by an
17 interlocal agreement between the district and the local
18 governing body.
19 Section 6. A safe neighborhood improvement district
20 that has a university police patrol may enter into an
21 interlocal agreement pursuant to section 163.01, Florida
22 Statutes, with the unit of local government that created the
23 district and other units of local government, pertaining to
24 the operation of the district. The agreement may include
25 provisions regarding mutual aid, cooperation, sharing of
26 resources, budgeting, and financial assistance.
