15         On page 16, line 31,

17  insert:

18         Section 6.  Subsection (8) of section 957.04, Florida

19  Statutes, is amended to read:

20         957.04  Contract requirements.--

21         (8)  For the 1996-1997 fiscal year only, the

22  Correctional Privatization Commission may expend appropriated

23  funds to assist in defraying impact costs that are incurred by

24  a municipality or county and are associated with the opening

25  and operating of a facility under the authority of the

26  commission and within that municipality or county.  The amount

27  that may be paid under this subsection for any facility may

28  not exceed 1 percent of the facility construction cost, less

29  any building and construction impact fees imposed during the

30  permitting process for the facility.  This subsection applies

31  only to facilities contracted under the authority of the

 1  1996-1997 General Appropriations Act.  This subsection is

 2  repealed on July 1, 1997. Buildings and other improvements to

 3  real property which are financed under paragraph (2)(a) and

 4  which are leased to the Correctional Privatization Commission

 5  are considered to be owned by the Correctional Privatization

 6  Commission for the purposes of this section whereby the terms

 7  of the lease, the buildings, and other improvements will

 8  become the property of the state at the expiration of the

 9  lease. For any facility that is bid and built under the

10  authority of requests for proposals made by the Correctional

11  Privatization Commission between December 1993 and October

12  1994 and that is operated by a private vendor, a payment in

13  lieu of taxes, from funds appropriated for the Correctional

14  Privatization Commission, shall be paid until the expiration

15  of the lease to local taxing authorities in the local

16  government in which the facility is located in an amount equal

17  to the ad valorem taxes assessed by counties, municipalities,

18  school districts, and special districts.
