15         On page 16, line 31,

17  insert:

18         Section 6.  Paragraph (l) of subsection (2) of section

19  110.205, Florida Statutes, is amended to read:

20         110.205  Career service; exemptions.--

21         (2)  EXEMPT POSITIONS.--The exempt positions which are

22  not covered by this part include the following, provided that

23  no position, except for positions established for a limited

24  period of time pursuant to paragraph (h), shall be exempted if

25  the position reports to a position in the career service:

26         (l)  All assistant division director, deputy division

27  director, and bureau chief positions in any department, and

28  those positions determined by the department to have

29  managerial responsibilities comparable to such positions,

30  which positions include, but are not limited to, positions in

31  the Department of Children and Family Health and

 1  Rehabilitative Services and the Department of Corrections that

 2  are assigned primary duties of serving as the superintendent

 3  or assistant superintendent of an institution; positions in

 4  the Department of Corrections that are assigned primary duties

 5  of serving as the circuit administrator or deputy circuit

 6  administrator;: positions in the Department of Transportation

 7  that are assigned primary duties of serving as regional toll

 8  managers and managers of offices as defined in s.

 9  20.23(3)(d)3. and (4)(d); positions in the Department of

10  Environmental Protection that are assigned the duty of an

11  Environmental Administrator or program administrator; and

12  positions in the Department of Health and Rehabilitative

13  Services that are assigned the duty of an Environmental

14  Administrator. Unless otherwise fixed by law, the department

15  shall set the salary and benefits of these positions in

16  accordance with the rules established for the Selected Exempt

17  Service.
