  1                      A bill to be entitled

  2         An act relating to motorcycle riders; amending

  3         s. 316.211, F.S.; exempting persons of a

  4         specified age from certain safety equipment

  5         requirements; requiring insurance coverage

  6         under certain conditions; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (3) of section 316.211, Florida

12  Statutes, is amended to read:

13         316.211  Equipment for motorcycle and moped riders.--

14         (3)  This section shall not apply to persons riding

15  within an enclosed cab or to any person 16 years of age or

16  older who is operating or riding upon a motorcycle powered by

17  a motor with a displacement of 50 cubic centimeters or less or

18  is rated not in excess of 2 brake horsepower and which is not

19  capable of propelling such motorcycle at a speed greater than

20  30 miles per hour on level ground, or to persons over the age

21  of 21 years. In order to ride a motorcycle without wearing

22  protective headgear a person over the age of 21 must obtain

23  bodily injury liability insurance in the minimum amount of

24  $20,000 per person, $40,000 per accident and medical payment

25  coverage for the driver and all passengers of the motorcycle

26  of at least $10,000 for the driver and each person.  The

27  operator of the motorcycle must have proof of insurance on his

28  or her person in order to operate the motorcycle and shall be

29  required to provide proof of insurance upon demand by any law

30  enforcement officer.

31         Section 2.  This act shall take effect July 1, 1999.

      Provides that persons over the age of 21 years do not
  4    need protective headgear to operate a motorcycle so long
      as the person obtains bodily injury liability insurance
  5    in the minimum amount of $20,000 per person, $40,000 per
      accident and medical payment coverage for the driver and
  6    all passengers of the motorcycle of at least $10,000 for
      the driver and each passenger. Provides that the operator
  7    of the motorcycle must have proof of insurance on his or
      her person in order to operate the motorcycle and shall
  8    be required to provide proof of insurance upon demand to
      any law enforcement officer.
