11  Senators Cowin and McKay moved the following amendment:

13         Senate Amendment 

14         On page 15, lines 3-12, delete those lines

15

16  and insert:

17         (a)  Demonstrate fiscal soundness by being in operation

18  for one school year, or provide the Department of Education

19  with a statement by a certified public accountant confirming

20  that the private school desiring to participate is insured,

21  has secured a facility that has met local health and safety

22  codes, and the owner or owners have sufficient capital or

23  credit to operate the school for the upcoming year serving the

24  number of students anticipated with expected revenues from

25  tuition and other sources that may be reasonably expected.  In

26  lieu of such a statement, a surety bond or letter of credit

27  for the amount equal the opportunity scholarship funds for any

28  quarter may be filed with the Department.
