15         On page 15, lines 3-12, delete those lines

16

17  and insert:

18         (a)  Demonstrate fiscal soundness by being in operation

19  for at least one school year and provide the Department of

20  Education with a statement by a certified public accountant

21  confirming that the private school desiring to participate is

22  insured, has secured a facility that has met local health and

23  safety codes, and the owner or owners have sufficient capital

24  or credit to operate the school for the upcoming year serving

25  the number of students anticipated with expected revenues from

26  tuition and other sources that may be reasonably expected.  In

27  lieu of such a statement, a surety bond or letter of credit

28  for the amount equal the opportunity scholarship funds for any

29  quarter may be filed with the Department.
