11  Senator Sullivan moved the following amendment:

13         Senate Amendment 

14         On page 40, line 14, after the period

15

16  insert:  Schools that record a mobility rate of 40% or more,

17  based on the comparison of spring statistics and fall

18  statistics in districts that are required by court order to

19  systematically and regularly move students among schools for

20  the purpose of desegregation shall not be included in the

21  identification process for failing schools.  The mobility rate

22  shall include only those students whose grade level, upon

23  promotion, would still be included in that school structure.
