  1                      A bill to be entitled

  2         An act relating to use of public rights-of-way;

  3         amending s. 337.401, F.S.; specifying that

  4         specified provisions do not apply to the

  5         provision of pay telephone service on public or

  6         municipal roads or rights-of-way; providing for

  7         application; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (10) is added to section

12  337.401, Florida Statutes, 1998 Supplement, to read:

13         337.401  Use of right-of-way for utilities subject to

14  regulation; permit; fees.--

15         (10)  This section, except subsection (6), does not

16  apply to the provision of pay telephone service on public or

17  municipal roads or rights-of-way.

18         Section 2.  This act does not apply to any contract

19  entered into before the effective date of this act.

20         Section 3.  This act shall take effect upon becoming a

21  law.

23          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
24                             SB 1758

26  Frees counties and cities from the maximum fee provisions in
    existing law for permitting pay phones on public
27  rights-of-way, and from current law restrictions on taxes,
    licenses, fees, or solicitations of in-kind contributions in
28  consideration for these permits.

29  Indicates that the change to existing law will not apply to
    contracts entered into before the effective date of the act.
