20 limited to the wage reports for the preceding 16 calendar
21 quarters.
22 (2) Creditors must obtain written consent from the
23 credit applicant. Any such written consent from the credit
24 applicant must be signed and must include the following:
25 (a) Specific notice that the individual's wage and
26 employment history information will be released to a
27 consumer-reporting agency;
28 (b) Notice that such release is made for the sole
29 purpose of reviewing a specific application for credit made by
30 the individual;
31 (c) Notice that the files of the Department of Labor

1 and Employment Security containing wage and employment history
2 information submitted by the individual or his or her
3 employers may be accessed; and
4 (d) A listing of the parties authorized to receive the
5 released information.
6 (3) Consumer-reporting agencies and creditors
7 accessing information under this section must safeguard the
8 confidentiality of such information and shall use the
9 information only to support a single consumer credit
10 transaction for the creditor to satisfy standard financial
11 underwriting requirements or other requirements imposed upon
12 the creditor, and to satisfy the creditor's obligations under
13 applicable state or federal Fair Credit Reporting laws and
14 rules governing this section.
15 (4) Should any consumer-reporting agency or creditor
16 violate any provision of this section, the Department of Labor
17 and Employment Security shall, upon thirty days written notice
18 to the consumer-reporting agency, terminate the contract
19 established between the department and the consumer-reporting
20 agency resulting from this section.
21 (5) For purposes of this section, "creditor" has the
22 same meaning as set forth in the federal Fair Debt Collection
23 Practices Act, 15 U.S.C. s. 1692 et seq.
