3 disposal systems; amending s. 381.0066, F.S.;
4 reducing annual operating permit fees for
5 aerobic treatment units; eliminating the annual
6 aerobic treatment unit maintenance entity
7 permit fee; amending s. 381.0065, F.S.;
8 correcting a cross reference; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (2) of section 381.0066, Florida
14 Statutes, is amended to read:
15 381.0066 Onsite sewage treatment and disposal systems;
16 fees.--
17 (2) The minimum fees in the following fee schedule
18 apply until changed by rule by the department within the
19 following limits:
20 (a) Application review, permit issuance, or system
21 inspection, including repair of a subsurface, mound, filled,
22 or other alternative system or permitting of an abandoned
23 system: a fee of not less than $25, or more than $125.
24 (b) Site evaluation, site reevaluation, evaluation of
25 a system previously in use, or a per annum septage disposal
26 site evaluation: a fee of not less than $40, or more than
27 $115.
28 (c) Annual operating permit for aerobic treatment
29 units, including quarterly evaluation, annual sampling, and
30 laboratory analysis of effluent from aerobic treatment units:
31 a fee of not less than $50 $150, or more than $100 $300.

1 (d) Annual operating permit for systems located in
2 areas zoned for industrial manufacturing or equivalent uses or
3 where the system is expected to receive wastewater which is
4 not domestic in nature: a fee of not less than $150, or more
5 than $300.
6 (e) Innovative technology: a fee not to exceed
7 $25,000.
8 (f) Septage disposal service, septage stabilization
9 facility, portable or temporary toilet service, tank
10 manufacturer inspection: a fee of not less than $25, or more
11 than $200, per year.
12 (g) Application for variance: a fee of not less than
13 $150, or more than $300.
14 (h) Annual operating permit for waterless,
15 incinerating, or organic waste composting toilets: a fee of
16 not less than $50, or more than $150.
17 (i) Aerobic treatment unit maintenance entity permit:
18 a fee of not less than $25, or more than $150, per year.
19 (i)(j) Reinspection fee per visit for site inspection
20 after system construction approval or for noncompliant system
21 installation per site visit: a fee of not less than $25, or
22 more than $100.
23 (j)(k) Research: An additional $5 fee shall be added
24 to each new system construction permit issued during fiscal
25 years 1996-2002 to be used for onsite sewage treatment and
26 disposal system research, demonstration, and training
27 projects.
28 (k)(l) Annual operating permit, including annual
29 inspection and any required sampling and laboratory analysis
30 of effluent, for an engineer-designed performance-based
31 system: a fee of not less than $150, or more than $300.

2 The funds collected pursuant to this subsection must be
3 deposited in a trust fund administered by the department, to
4 be used for the purposes stated in this section and ss.
5 381.0065 and 381.00655.
6 Section 2. Paragraph (j) of subsection (3) of section
7 381.0065, Florida Statutes, 1998 Supplement, is amended to
8 read:
9 381.0065 Onsite sewage treatment and disposal systems;
10 regulation.--
11 (3) DUTIES AND POWERS OF THE DEPARTMENT OF
12 HEALTH.--The department shall:
13 (j) Supervise research on, demonstration of, and
14 training on the performance, environmental impact, and public
15 health impact of onsite sewage treatment and disposal systems
16 within this state. Research fees collected under s.
17 381.0066(2)(j)(k) must be used to develop and fund hands-on
18 training centers designed to provide practical information
19 about onsite sewage treatment and disposal systems to septic
20 tank contractors, master septic tank contractors, contractors,
21 inspectors, engineers, and the public and must also be used to
22 fund research projects which focus on improvements of onsite
23 sewage treatment and disposal systems, including use of
24 performance-based standards and reduction of environmental
25 impact. Research projects shall be initially approved by the
26 technical advisory panel and shall be applicable to and
27 reflect the soil conditions specific to Florida. Such
28 projects shall be awarded through competitive negotiation,
29 using the procedures provided in s. 287.055, to public or
30 private entities that have experience in onsite sewage
31 treatment and disposal systems in Florida and that are

1 principally located in Florida. Research projects shall not
2 be awarded to firms or entities that employ or are associated
3 with persons who serve on either the technical advisory panel
4 or the research review and advisory committee.
5 Section 3. This act shall take effect July 1, 1999.

With respect to onsite sewage treatment and disposal
10 systems:
11 1. Provides that the annual operating permit fee
for aerobic treatment units shall be not less than $50
12 nor more than $100, rather than not less than $150 nor
more then $300.

2. Eliminates the current annual aerobic treatment
14 unit maintenance entity fee of not less than $25 nor more
than $150.
