  1                      A bill to be entitled

  2         An act relating to homicide; creating s.

  3         782.091, F.S.; making it unlawful to stop

  4         parturition by removal or destruction of

  5         intracranial contents under specified

  6         circumstances; providing penalties; providing

  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 782.091, Florida Statutes, is

12  created to read:

13         782.091  Killing fetus by removal or destruction of

14  intracranial contents.--It is unlawful to stop parturition by

15  means of a complete or partial removal of the intracranial

16  contents of the fetus or the destruction of such contents with

17  the premeditated intent to cause the death of the fetus. Any

18  person who violates this section commits a felony of the

19  second degree, punishable as provided in s. 775.082, s.

20  775.083, or s. 775.084.

21         Section 2.  This act shall take effect October 1, 1999.
