1 A bill to be entitled
2 An act relating to driver's licenses; amending
3 s. 322.08, F.S.; authorizing the Department of
4 Highway Safety and Motor Vehicles to require
5 driver's license applicants to submit
6 fingerprints; prohibiting the department from
7 issuing a driver's license before completing an
8 examination of the applicant's record;
9 requiring the department to request and receive
10 information from, and exchange information
11 with, other jurisdictions; authorizing the
12 department to adopt rules; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsections (2) and (3) of section 322.08,
18 Florida Statutes, 1998 Supplement, are amended to read:
19 322.08 Application for license.--
20 (2) Each such application shall reflect the full name
21 (first, middle or maiden, and last), proof of identity
22 satisfactory to the department, proof of birth date
23 satisfactory to the department, sex, social security number,
24 and residence and mailing address of the applicant, and
25 briefly describe the applicant, and shall state whether the
26 applicant has previously been licensed to drive, and if so,
27 when and by what state, and whether any such license or
28 driving privilege has ever been disqualified, revoked, or
29 suspended, or whether an application has ever been refused,
30 and if so, the date of and reason for such disqualification,
31 suspension, revocation, or refusal. The department shall not

1 issue a driver's license until a complete examination of the
2 application has been made. The department shall adopt such
3 rules as are necessary for the orderly processing of driver's
4 license applications. The department may require the applicant
5 to submit fingerprints by means of an inkless fingerprint
6 scanning device at the time of application. The department may
7 not issue a license until it has made a complete examination
8 of the applicant's record. The department may adopt rules that
9 are necessary for the orderly processing of license
10 applications.
11 (3) Each such application shall include a consent to
12 release driving record information which requires, entitling
13 the department to request, receive, and exchange such
14 information with other jurisdictions.
15 Section 2. This act shall take effect July 1, 1999.

18 SENATE SUMMARY
19 Authorizes the Department of Highway Safety and Motor
Vehicles to adopt rules for orderly processing of
20 driver's license applications. Authorizes the department
to require driver's license applicants to submit
21 fingerprints by means of inkless scanning devices.
Prohibits the department from issuing a driver's license
22 until the applicant's record has been examined. Removes
the department's discretion to not request and receive
23 information from, and exchange information with, other
jurisdictions.
