  1                      A bill to be entitled

  2         An act relating to automatic teller machine

  3         transaction surcharges; creating s. 655.966,

  4         F.S.; prohibiting financial institutions from

  5         imposing surcharges on transactions at certain

  6         automatic teller machines; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 655.966, Florida Statutes, is

12  created to read:

13         655.966  Automatic teller machine transaction surcharge

14  prohibition.--In the case of any electronic fund transfer that

15  is initiated by a consumer from an electronic terminal

16  operated by a person other than the financial institution

17  holding the account of the consumer and that uses a national

18  or regional communication network to effect the transaction

19  between such person and the financial institution holding the

20  account of the customer, no fee may be imposed on the consumer

21  with respect to such transaction by the person operating the

22  electronic terminal at which the transfer is initiated.

23         Section 2.  This act shall take effect upon becoming a

24  law.
