14         On page 16, line 29, of the bill

16  insert a new section 16:

17         Section 16.  In order to implement Specific

18  Appropriation 360 of the 1999-2000 General Appropriations Act,

19  subsection 4 is added to section 39.3065, Florida Statutes, to

20  read:

21         39.3065  Sheriffs of Pasco, Manatee, and Pinellas

22  Counties to provide child protective investigative services;

23  procedures; funding.--

25         (a)  As described in this section, and in addition to

26  the requirements of subsection (1), the Department of Children

27  and Family Services shall, by the end of fiscal year

28  1999-2000, transfer all responsibility for child protective

29  investigations for Broward County to the sheriff of that

30  county who is responsible for the provision of all child

31  protective investigations in that county.  Each individual who

 1  provides these services must complete the training provided to

 2  and required of protective investigators employed by the

 3  Department of Children and Family Services.

 4         (b)  In fiscal year 1999-2000, the sheriff of Broward

 5  County has the responsibility to provide all child protective

 6  investigations in that county.  The sheriff shall operate, at

 7  a minimum, in accordance with the performance standards

 8  established by the Legislature for protective investigations

 9  conducted by the Department of Children and Family Services.

10  Funds for providing child protective investigations in Broward

11  County must be be identified in the annual appropriation made

12  to the Department of Children and Family Services, which shall

13  award a grant for the full amount identified to the sheriff's

14  office.  Funds for the child protective investigations may not

15  be integrated into the sheriff's regular budget.  Budgetary

16  data and other data relating to the performance of child

17  protective investigations must be maintained separately from

18  all other records of the sheriff's office.

19         (c)  Notwithstanding paragraph (3)(d), program

20  performance evaluation shall be based on criteria mutually

21  agreed upon by the respective sheriffs and a committee of nine

22  persons appointed by the Governor and selected from those

23  persons serving on the Department of Children and Family

24  Services District 5 Health and Human Services Board, District

25  6 Health and Human Services Board and District 10 Health and

26  Human Services Board.  Two of the Governor's appointees must

27  be residents of Pasco County, two of the Governor's appointees

28  must be residents of Manatee County, two of the Governor's

29  appointees must be residents of Pinellas County, and two of

30  the Governor's appointees must be residents of Broward County.

31  Such appointees shall serve at the pleasure of the Governor.

 1  The individuals appointed must have demonstrated experience in

 2  outcome evaluation, social service areas of protective

 3  investigation, or child welfare supervision.  The committee

 4  shall submit a report regarding quality performance,

 5  outcome-measure attainment and cost efficiency, to the

 6  President of the Senate, the Speaker of the House of

 7  Representatives, and to the Governor no later than January 31,

 8  2000.

 9         (d)  This subsection is repealed on July 1, 2000.
