  1                      A bill to be entitled

  2         An act relating to amusement games or machines;

  3         amending s. 849.161, F.S.; providing that

  4         chapter 849, F.S., is not applicable to certain

  5         coin-operated games; providing an effective

  6         date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Paragraph (b) of subsection (1) of section

11  849.161, Florida Statutes, is amended to read:

12         849.161  Amusement games or machines; when chapter

13  inapplicable.--

14         (1)

15         (b)  Nothing in this chapter subsection shall be taken

16  or construed as applicable to a coin-operated game or device

17  designed and manufactured only for bona fide amusement

18  purposes which game or device may by application of skill

19  entitle the player to replay the game or device at no

20  additional cost, if the game or device: can accumulate and

21  react to no more than 15 free replays; can be discharged of

22  accumulated free replays only by reactivating the game or

23  device for one additional play for such accumulated free

24  replay; can make no permanent record, directly or indirectly,

25  of free replays; and is not classified by the United States as

26  a gambling device in 24 U.S.C. s. 1171, which requires

27  identification of each device by permanently affixing seriatim

28  numbering and name, trade name, and date of manufacture under

29  s. 1173, and registration with the United States Attorney

30  General, unless excluded from applicability of the chapter

31  under s. 1178.  This subsection shall not be construed to

  1  authorize video poker games, or any other game or machine that

  2  may be construed as a gambling device under Florida law.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.

  8    Provides for the operation of certain coin-operated games
      notwithstanding the prohibitions against gambling in
  9    chapter 849, F.S.
