1 A bill to be entitled
2 An act relating to lead-acid battery fees;
3 amending s. 403.7185, F.S.; authorizing the
4 Department of Environmental Protection to use a
5 percentage of such fees collected to make
6 grants to fund assessment and remediation of
7 contaminated sites and to provide incentives
8 for recycling facilities for lead-acid
9 batteries and other lead-containing waste
10 products; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (4) is added to section
15 403.7185, Florida Statutes, to read:
16 403.7185 Lead-acid battery fees.--
17 (4) At least 15 percent of the revenues collected
18 annually from the lead-acid battery fees shall be designated
19 by the Department of Environmental Protection as grant moneys
20 to provide funding for contamination assessment and
21 remediation of sites contaminated by the disposal of lead-acid
22 batteries, and the components thereof, and to provide
23 incentives to assist recycling facilities for lead-acid
24 batteries and other lead-containing solid waste products to
25 provide a convenient opportunity for safe recycling and proper
26 disposal of waste products containing lead. The Legislature
27 recognizes a need for providing a capability within the state
28 for responding to the recycling, proper disposal, and
29 remediation of waste products generated by users of
30 lead-containing products within this state. Incentive grants
31 may be made for funding public or private activities that are

1 innovative or necessary to maintain environmental compliance
2 with federal and state regulatory requirements.
3 Section 2. This act shall take effect July 1, 1999.

6 HOUSE SUMMARY

Authorizes the Department of Environmental Protection to
8 designate at least 15 percent of the lead-acid battery
fees collected annually for grants to fund assessment and
9 remediation of sites contaminated by disposal of
lead-acid batteries and to provide incentives for
10 recycling facilities for such batteries and other
lead-containing waste products.
