  1                      A bill to be entitled

  2         An act relating to the Department of Children

  3         and Family Services; providing for waiver of

  4         specified provisions of s. 20.19, F.S.;

  5         directing the department to consult with the

  6         Executive Office of the Governor in

  7         implementing waiver authority; requiring a

  8         report; requiring a comprehensive

  9         reorganization plan; specifying that other

10         statutory responsibilities or related rules are

11         not impaired; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  (1)  The following provisions of section

16  20.19, Florida Statutes, 1998 Supplement, are waived until

17  July 1, 2000, for the purpose of allowing the Department of

18  Children and Family Services to organize programs, districts,

19  and functions of the department to achieve more effective and

20  efficient service delivery and improve accountability,

21  notwithstanding the provisions of section 20.04, Florida

22  Statutes:

23         (a)  Section 20.19(2)(b) and (f) Florida Statutes, 1998

24  Supplement, relating to the secretary and deputy secretary.

25         (b)  Section 20.19(3), Florida Statutes, 1998

26  Supplement, relating to the Office of Standards and

27  Evaluation.

28         (c)  Section 20.19(5)(a), Florida Statutes, 1998

29  Supplement, relating to program offices.

  1         (d)  Section 20.19(6)(a), (c), and (d), Florida

  4         (e)  Section 20.19(8)(l), (m), (n), and (o), Florida

  5  Statutes, 1998 Supplement, relating to health and human

  6  services boards.

  7         (f)  Section 20.19(9), Florida Statutes, 1998

  8  Supplement, relating to district nominee qualifications review

  9  committees.

10         (g)  Section 20.19(10), (a), (b), (c)1.-7., (d), (e),

11  (f), and (g), Florida Statutes, 1998 Supplement, relating to

12  the district administrator.

13         (h)  Section 20.19(12)(d), Florida Statutes, 1998

14  Supplement, relating to the departmental budget.

16  Actions taken under the authority granted by this section must

17  be taken in consultation with the Executive Office of the

18  Governor. The secretary shall submit a report describing

19  actions taken and additional plans for implementing the

20  provisions of this section to the Governor, the President of

21  the Senate, and the Speaker of the House of Representatives by

22  August 1, 1999.

23         (2)  The secretary shall submit a comprehensive

24  reorganization plan to the Governor, the President of the

25  Senate, and the Speaker of the House of Representatives by

26  January 1, 2000. The comprehensive reorganization plan must

27  describe the organizational and program restructuring

28  activities that have occurred since the effective date of this

29  act, including indications of an improved ability to carry out

30  the department's mission under section 20.19(1), Florida

31  Statutes, 1998 Supplement, and any organizational

  1  efficiencies. The plan must also describe what strategies

  2  proved to be ineffective or inefficient. The plan must include

  3  any recommendations for reorganization, including program and

  4  organizational restructuring and any statutory revisions.

  5         (3)  The provisions of this act shall not impair the

  6  operation of any other statutory responsibilities, or the

  7  rules adopted thereunder, which are specifically conferred by

  8  statute until such statutes or rules are specifically amended

  9  or repealed in the manner provided by law.

10         Section 2.  This act shall take effect upon becoming a

11  law.

13          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
14                         Senate Bill 1902

16  Specifies several provisions in s. 20.19, F.S., 1998
    Supplement, that would be waived for the Department of
17  Children and Family Services until July 1, 2000.

18  Specifies that the provisions of s.20.04, F.S., would not
    apply to pertinent operations of the department that are
19  affected by this bill until July 1, 2000.

20  Specifies that the purpose of waiving provisions in s. 20.19,
    F.S., 1998 Supplement, is to allow the Department of Children
21  and Family Services to organize programs, districts, and
    functions of the department to achieve a more effective and
22  efficient service delivery system and to improve
    accountability.

    Directs the Secretary of the Department of Children and Family
24  Services to submit a report to the Governor and the
    Legislature no later than August 1, 1999, describing actions
25  that have been taken and additional plans for operating the
    department's programs and services under those provisions
26  waived by this bill in s. 20.19, F.S., 1998 Supplement.

27  Directs the Secretary to develop a comprehensive
    reorganization plan and to submit it to the Governor and
28  Legislature no later than January 1, 2000, and specifies its
    content.

    Specifies that all laws and rules governing the statutory
30  responsibilities of the department's services and programs are
    unchanged until such laws or rules are amended or repealed in
31  accordance with Florida law.
