  2         An act relating to license plates; amending ss.

  3         320.08056, 320.08058, F.S.; creating a Florida

  4         Wildflower license plate; providing for the

  5         distribution of annual use fees received from

  6         the sale of such plates; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Paragraph (z) is added to subsection (4) of

12  section 320.08056, Florida Statutes, 1998 Supplement, to read:

13         320.08056  Specialty license plates.--

14         (4)  The following license plate annual use fees shall

15  be collected for the appropriate specialty license plates:

16         (z)  Florida Wildflower license plate, $15.

17         Section 2.  Subsection (26) is added to section

18  320.08058, Florida Statutes, 1998 Supplement, to read:

19         320.08058  Specialty license plates.--

20         (26)  FLORIDA WILDFLOWER LICENSE PLATES.--

21         (a)  The department shall develop a Florida Wildflower

22  license plate as provided in this section. The word "Florida"

23  must appear at the top of the plate, and the words "State

24  Wildflower" and "coreopsis" must appear at the bottom of the

25  plate.

26         (b)  The annual use fees shall be distributed to the

27  Wildflower Account established by Keep Florida Beautiful,

28  Inc., created by s. 403.4131. The proceeds must be used to

29  establish native Florida wildflower research programs,

30  wildflower educational programs, and wildflower grant programs

31  to municipal, county, and community-based groups in this

  1  state. A maximum of 10 percent of the proceeds from the sale

  2  of such plates may be used for administrative costs.

  3         Section 3.  Subsection (11) is added to section

  4  403.4131, Florida Statutes, 1998 Supplement, to read:

  5         403.4131  "Keep Florida Beautiful, Incorporated";

  6  placement of signs.--

  7         (11)(a)  There is created within Keep Florida

  8  Beautiful, Inc., the Wildflower Advisory Council, consisting

  9  of a maximum of nine members to direct and oversee the

10  expenditure of the Wildflower Account. The Wildflower Advisory

11  Council shall include a representative from the University of

12  Florida Institute of Food and Agricultural Sciences, the

13  Florida Department of Transportation, and the Florida

14  Department of Environmental Protection, the Florida League of

15  Cities, and the Florida Association of Counties. Other members

16  of the committee may include representatives from The Florida

17  Federation of Garden Clubs, Inc., Think Beauty Foundation, the

18  Florida Chapter of the American Society of Landscape

19  Architects, Inc., and a representative of the Master

20  Gardener's Program.

21         (b)  The Wildflower Advisory Council shall develop

22  procedures of operation, research contracts, educational

23  programs, and wildflower planting grants for Florida native

24  wildflowers, plants and grasses.  The council shall also make

25  the final determination of what constitutes acceptable species

26  of wildflowers and other plantings supported by these

27  programs.

28         Section 4.  This act shall take effect July 1, 1999.
