17 Section 8. Paragraph (a) of subsection (2) of section
18 231.02, Florida Statutes, 1998 Supplement, is amended to read:
19 231.02 Qualifications of personnel.--
20 (2)(a) Instructional and noninstructional personnel
21 who are hired or contracted individually or by an agency to
22 fill positions requiring direct contact with students in any
23 district school system or laboratory school shall, upon
24 employment, file a complete set of fingerprints taken by an
25 authorized law enforcement officer or an employee of the
26 school or district who is trained to take fingerprints. These
27 fingerprints shall be submitted to the Department of Law
28 Enforcement for state processing and to the Federal Bureau of
29 Investigation for federal processing. School districts that
30 have authorized criminal justice terminal access to the
31 Florida Crime Information Center Telecommunications Network

Amendment No.
1 may use this equipment for the background check of district
2 employees or employees contracted individually or by an
3 agency. However, the background check may not be in lieu of
4 the requirement that fingerprints bey submitted to the Florida
5 Department of Law Enforcement. Such new employees shall be on
6 probationary status pending fingerprint processing and
7 determination of compliance with standards of good moral
8 character. Employees found through fingerprint processing to
9 have been convicted of, found guilty of, or entered a plea of
10 guilty or nolo contendere, regardless of adjudication to a
11 crime involving moral turpitude or other crime under s.
12 435.04, may shall not be employed in any position, except as
13 specifically approved by the district school board in
14 accordance with chapter 435 requiring direct contact with
15 students. Probationary employees terminated because of their
16 criminal record shall have the right to appeal such decisions.
17 The cost of the fingerprint processing may be borne by the
18 school board, or the employee, or the contracted individual.
19 School districts may enter into an agreement with the Florida
20 Department of Law Enforcement for purposes of conducting
21 school volunteer background checks. Such agreements shall be
22 executed by the respective school superintendent and the
23 Executive Director of the Florida Department of Law
24 Enforcement.
