13         Senate Amendment 

14         On page 10, line 19, after the period

16  insert:  However, with respect to a person who is subject to

17  prosecution under subparagraph (a)1. and who has not

18  previously been convicted as a felon, the state attorney, in

19  his or her sound discretion, may seek, and the court may

20  impose, a sentence that is less than the mandatory minimum

21  provided in subparagraph (a)1.
