17  and insert in lieu thereof:  (f)1.  A taxpayer who is required

18  to remit taxes by electronic funds transfer may elect to shall

19  make a return in a manner that is initiated through an

20  electronic data interchange.  The acceptable method of

21  transfer, the method, form, and content of the electronic data

22  interchange, giving due regard to developing uniform standards

23  for formats as adopted by the American National Standards

24  Institute, the circumstances under which an electronic data

25  interchange shall serve as a substitute for the filing of

26  another form of return, and the means, if any, by which

27  taxpayers will be provided with acknowledgments, shall be as

28  prescribed by the department. The department must accept such

29  returns as timely if initiated and accepted on or before the

30  20th day of the month, or on or before the 28th day of the

31  month if the dealer is required to file under paragraph (a).

 1  If the filing date deadline 20th day falls on a Saturday,

 2  Sunday, or federal or state legal holiday, returns must be

 3  accepted as timely if initiated and accepted on the next

 4  succeeding workday.

 5         2.  The department may waive the requirement to make a

 6  return through an electronic data interchange due to problems

 7  arising from the taxpayer's computer capabilities, data

 8  systems changes, and taxpayer operating procedures.  To obtain

 9  a waiver, the taxpayer shall demonstrate in writing to the

10  department that such circumstances exist.
