13         Amendment (with title amendment) 

14         On page 47, between lines 12 and 13 of the bill

15

16  insert:  (9)  Any plaintiff who prevails in a civil action as

17  defined in section 400.023 against a facility awarded the Gold

18  Seal may be entitled to recover reasonable attorney's fees not

19  to exceed $50,000, costs of action, and damages, unless the

20  court finds that the plaintiff has acted in bad faith, with

21  malicious purpose, and that there was a complete absence of a

22  justiciable issue of either law or fact.
