15 On page 47, between lines 12 and 13 of the bill

17 insert: (9) Any attorneys' fees awarded in a civil action
18 under s. 400.023 and any costs awarded for expert witness fees
19 in such an action, against a nursing facility that was, at the
20 time the action was brought, designated as a Gold Seal
21 facility pursuant to this section, shall not exceed in the
22 aggregate a total of $50,000 unless the court determines that
23 the facility has acted in bad faith, with malicious intent,
24 and that there was a complete absence of a justiciable issue
25 of either law or fact.
