14         On page 7, line 23 of the bill

15

16  insert:  (c)  "Necessary for the resident's welfare" means

17  that, by objective criteria as provided in rules of the

18  agency, the resident's physical or emotional well-being would

19  more likely than not be harmed by remaining in the facility

20  and receiving adequate levels of care, which harm would be

21  less likely to occur if the resident were discharged or

22  transferred.

23         (d)  "The resident's needs cannot be met in the

24  facility" means that the resident's medical condition has

25  changed to the extent that the resident now needs additional

26  or different treatments or advanced levels of care which the

27  facility does not provide to any resident of the facility.
