13         Substitute Amendment for Amendment (544915) 

14         On page 33, line 31 of the bill after the period

15

16  insert:  Unless otherwise approved by the agency, licensed

17  nurses counted towards the minimum staffing requirements for

18  certified nursing assistants must exclusively perform the

19  duties of a certified nursing assistant for the entire shift

20  and shall not also be counted towards the minimum staffing

21  requirements for licensed nurses. If the agency approved a

22  facility's request to use a licensed nurse to perform both

23  licensed nursing and certified nursing assistant duties, the

24  facility must allocate the amount of staff time specifically

25  spent on certified nursing assistant duties for the purpose of

26  documenting compliance with minimum staffing requirements for

27  certified and licensed nursing staff. In no event may the

28  hours of a licensed nurse with dual job responsibilities be

29  counted twice.
