  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         Florida Organ and Tissue Donor Education and

  4         Procurement Trust Fund within the Agency for

  5         Health Care Administration without

  6         modification; carrying forward current balances

  7         and continuing current sources and uses

  8         thereof; repealing s. 2, ch. 95-316, Laws of

  9         Florida; abrogating provisions relating to the

10         termination of the trust fund, to conform;

11         providing an effective date.

13         WHEREAS, the Legislature wishes to extend the life of

14  the Florida Organ and Tissue Donor Education and Procurement

15  Trust Fund within the Agency for Health Care Administration,

16  which is otherwise scheduled to be terminated pursuant to

17  constitutional mandate, and

18         WHEREAS, the Legislature has reviewed the trust fund

19  before its scheduled termination date and has found that it

20  continues to meet an important public purpose, and

21         WHEREAS, the Legislature has found that existing public

22  policy concerning the trust fund sets adequate parameters for

23  its use, NOW, THEREFORE,

25  Be It Enacted by the Legislature of the State of Florida:

26

27         Section 1.  (1)  The Florida Organ and Tissue Donor

28  Education and Procurement Trust Fund, FLAIR number 68-2-509,

29  which was created within the Agency for Health Care

30  Administration by chapter 95-316, Laws of Florida, and

31  assigned to section 732.92155, Florida Statutes, and which is

  1  to be terminated pursuant to Section 19(f), Article III of the

  2  State Constitution on July 1, 1999, is re-created.

  3         (2)  All current balances of the trust fund are carried

  4  forward, and all current sources and uses of the trust fund

  5  are continued.

  6         Section 2.  Section 2 of chapter 95-316, Laws of

  7  Florida, is repealed.

  8         Section 3.  This act shall take effect July 1, 1999.
