15 On page 3, lines 24-26, delete those lines

17 and insert:
18 Section 3. Section 627.7406, Florida Statutes, is
19 created to read:
20 627.7406 Prohibited billing by brokers.--Charges for
21 magnetic resonance imaging (MRI) or computed tomography (CT)
22 scan services covered by a policy of motor vehicle insurance
23 shall be unenforceable against the recipient of such services,
24 an insurer, a third-party payor, and any other person or
25 entity unless such charges are billed and collected by the
26 100-percent owner or the 100-percent lessee of the equipment
27 used to perform such services. Such owner or lessee may be an
28 individual, a corporation, a partnership, or any other entity
29 and any of its 100-percent-owned affiliates and subsidiaries.
30 For purposes of this section, "lessee" means a long-term
31 lessee under a capital or operating lease but does not include

1 a part-time lessee. This section does not apply to billing and
2 collection by a hospital, a hospital management company, or a
3 hospital and physician management company. This section also
4 does not apply to billing and collection by a physician
5 management company whose MRI and CT scan services are
6 ancillary to the physician practices managed, a debt
7 collection agency, or an entity that has contracted with an
8 insurer or third-party payor to obtain a discounted rate for
9 such MRI and CT scan services, provided such entity does not
10 retain for its services more than 25 percent of the amount
11 remitted to such 100-percent owner or lessee.
12 Section 4. This act shall take effect July 1, 1999,
13 and sections 1 and 2 shall apply to policies issued or renewed
14 on or after July 1, 2000.
