  1                      A bill to be entitled

  2         An act relating to the Department of Highway

  3         Safety and Motor Vehicles; amending s. 322.142,

  4         F.S.; requiring the department, prior to

  5         selling copies of photographs or certain other

  6         driver's license or identification card

  7         information, to verify with the Department of

  8         Law Enforcement that such information does not

  9         pertain to a law enforcement officer; providing

10         an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Subsection (5) of section 322.142, Florida

15  Statutes, 1998 Supplement, is amended to read:

16         322.142  Color photographic or digital imaged

17  licenses.--

18         (5)  Notwithstanding any other provisions of law, the

19  department may sell copies of photographs, electronically

20  stored photographs, or digitized images and other driver's

21  license and state identification card information on file,

22  which are recorded and maintained as required, if such items

23  are to be used solely for the prevention of fraud, including,

24  but not limited to, use in mechanisms intended to prevent the

25  fraudulent use of credit cards, debit cards, or checks, or

26  fraud in other forms of financial transactions.  The use of

27  such photographs, electronically stored photographs, or

28  digitized images obtained pursuant to this subsection is

29  limited to the verification of the identity of the holder of

30  an account, other form of identification, or other similar

31  uses, and may not be used for any other purpose. Prior to

  1  selling copies of photographs, electronically stored

  2  photographs, or digitized images and other driver's license

  3  and state identification card information on file as

  4  authorized by this section, the department must verify with

  5  the Department of Law Enforcement that the information being

  6  released does not pertain to an individual who is a law

  7  enforcement officer, as defined by s. 112.531(1).

  8         Section 2.  This act shall take effect upon becoming a

  9  law.
