18  and insert in lieu thereof:

19  state-funded land purchase programs shall be authorized, upon

20  a finding by the board of trustees, if they meet the criteria

21  specified in paragraphs (a)-(e): water resource development

22  projects, water supply development projects, stormwater

23  management projects, linear facilities, and sustainable

24  agriculture and forestry.  Such additional uses are authorized

25  where:

26         (a)  Not inconsistent with the management plan for such

27  lands;

28         (b)  Compatible with the natural ecosystem and resource

29  values of such lands;

30         (c)  The proposed use is appropriately located on such

31  lands and where due consideration is given to the use of other

 1  available lands;

 2         (d)  The using entity reasonably compensates the

 3  titleholder for such use based upon an appropriate measure of

 4  value; and

 5         (e)  The use provides a significant public interest.

 6  A decision by the board of trustees pursuant to this

 7  subsection shall be given a presumption of correctness.
