13         Amendment (with title amendment) 

14         On page 5, of the bill, between lines 29 and 30,

15

16  insert:

17         Section 7.  Subsection (2) of section 373.136, Florida

18  Statutes, is amended to read:

19         (2)  Any persons who prevail in an action or legal

20  proceeding brought against them by the department, the

21  governing board of any water management district, any local

22  board, or a local government to which authority has been

23  delegated under. 373.103(8). pursuant to this chapter shall be

24  entitled to recover reasonable attorney's fees and costs.

25         (3)  Any action by a citizen of the state to seek

26  judicial enforcement of any of the provisions of this chapter

27  shall be governed by the Florida Environmental Protection Act,

28  s. 403.412.
