  1                      A bill to be entitled

  2         An act relating to medical necessity; creating

  3         ss. 627.6015, 627.6511, 636.0035, 641.195,

  4         641.4025, and 641.475, F.S.; construing

  5         treatments or medications requested or

  6         prescribed by a licensed physician to be

  7         medically necessary for certain purposes;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Sections 627.6015, 627.6511, 636.0035,

13  641.195, 641.4025, and 641.475, Florida Statutes, are created

14  to read:

15         627.6015  Medical necessity.--Notwithstanding any other

16  provision of this part, any treatment or medication requested

17  or prescribed by a licensed physician for a patient under the

18  physician's care shall be deemed to be medically necessary for

19  purposes of this part.

20         627.6511  Medical necessity.--Notwithstanding any other

21  provision of this part, any treatment or medication requested

22  or prescribed by a licensed physician for a patient under the

23  physician's care shall be deemed to be medically necessary for

24  purposes of this part.

25         636.0035  Medical necessity.--Notwithstanding any other

26  provision of this part, any treatment or medication requested

27  or prescribed by a licensed physician for a patient under the

28  physician's care shall be deemed to be medically necessary for

29  purposes of this part.

30         641.195  Medical necessity.--Notwithstanding any other

31  provision of this part, any treatment or medication requested

  4         641.4025  Medical necessity.--Notwithstanding any other

  5  provision of this part, any treatment or medication requested

  6  or prescribed by a licensed physician for a patient under the

  7  physician's care shall be deemed to be medically necessary for

  8  purposes of this part.

  9         641.475  Medical necessity.--Notwithstanding any other

10  provision of this part, any treatment or medication requested

11  or prescribed by a licensed physician for a patient under the

12  physician's care shall be deemed to be medically necessary for

13  purposes of this part.

14         Section 2.  This act shall take effect upon becoming a

15  law.
