  1                      A bill to be entitled

  2         An act relating to state employees; creating s.

  3         110.1082, F.S.; prohibiting state employees

  4         from utilizing a voice mail system under

  5         certain circumstances; providing certain

  6         requirements with respect to telephone menu

  7         options; providing for compliance; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Section 110.1082, Florida Statutes, is

13  created to read:

14         110.1082  Telephone voice mail systems and telephone

15  menu options systems.--

16         (1)  No state employee shall utilize a voice mail

17  system when the employee is at his or her regularly assigned

18  work station where his or her telephone is functional and

19  available for use, unless:

20         (a)  The device is in use, and/or;

21         (b)  Such voice mail system alerts the caller to, and

22  provides the caller with access to a nonelectronic attendant;

23  or

24         (c)  Such voice mail system automatically transfers the

25  caller to a nonelectronic attendant.

26         (2)  Telephone menu options systems used by state

27  agencies, departments, or other state government units, will

28  alert the caller to, and provide the caller with access to a

29  nonelectronic attendant.

30         (3)  Agency heads will ensure compliance with the

31  provisions of this section.

  1         Section 2.  This act shall take effect October 1, 1999.
