1 A bill to be entitled
2 An act relating to health care; amending s.
3 409.9122, F.S.; requiring the Agency for Health
4 Care Administration, without preauthorization,
5 to provide recipients enrolled in managed care
6 plans or with MediPass providers with direct
7 access and reimbursement for services for
8 diagnosis and evaluation services provided by
9 child protection teams; amending s. 641.31,
10 F.S.; providing that a health maintenance
11 contract that provides services to a minor
12 child of a subscriber may not require any
13 preauthorization for services rendered by child
14 protection teams; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Subsection (13) is added to section
19 409.9122, Florida Statutes, 1998 Supplement, to read:
20 409.9122 Mandatory Medicaid managed care enrollment;
21 programs and procedures.--
22 (13) The agency shall provide recipients enrolled in
23 managed care plans or with MediPass providers direct access
24 and reimbursement for services for diagnosis and evaluation
25 services provided by child protection teams, established under
26 s. 39.303, without preauthorization related to alleged child
27 abuse, abandonment, or neglect as defined by policy or rule of
28 the Department of Health.
29 Section 2. Subsection (36) is added to section 641.31,
30 Florida Statutes, 1998 Supplement, to read:
31 641.31 Health maintenance contracts.--

1 (36) Notwithstanding any other provision of this
2 section, a health maintenance contract that provides services
3 to a minor child of a subscriber must not require any
4 preauthorization for services rendered by child protection
5 teams, established under s. 39.303, for diagnosis and
6 evaluation services related to alleged child abuse,
7 abandonment, or neglect, as defined by policy or rule of the
8 Department of Health.
9 Section 3. This act shall take effect July 1, 1999.

12 SENATE SUMMARY
13 Requires the Agency for Health Care Administration,
without preauthorization, to provide recipients enrolled
14 in managed care plans or with MediPass providers with
direct access and reimbursement for services for
15 diagnosis and evaluation services provided by child
protection teams. Provides that a health maintenance
16 contract that provides services to a minor child of a
subscriber may not require any preauthorization for
17 services rendered by child protection teams.
