17 Section 11. Section 414.1585 is created to read:

19 414.158 Diversion program for families at risk of welfare
20 dependency due to substance abuse or mental illness.
21 (1) The diversion program for families at risk of
22 welfare dependency due to substance abuse or mental illness is
23 intended to provide services and one-time payments to assist
24 families in avoiding welfare dependency and to stabilize
25 families so that children can be cared for in their own homes
26 or in the homes of relatives and so that families can be self
27 sufficient.
28 (2) Before finding a family eligible for the diversion
29 program created under this section, a determination must be
30 made that:
31 (a) The family includes a pregnant woman or a parent

1 with one or more minor children or a caretaker relative with
2 one or more minor children.
3 (b) The family meets criteria established by the
4 department that one or more individuals in the family are at
5 risk of or are impaired due to substance abuse or mental
6 illness.
7 (c) The services or one-time payment provided are not
8 considered assistance under federal law or guidelines.
9 (3) Notwithstanding any provision to the contrary in
10 ss. 414.075, 414.085, or 414.095, a family meeting the
11 criteria of subsection (2) shall a be considered a needy
12 family and shall be deemed eligible under this section.
13 (4) The department is authorized to promulgate rules
14 governing the administration of this section and may establish
15 additional criteria related to services, client need, or
16 one-time payments. The department may establish maximum
17 amounts of one-time payments in rule.
18 (5) Receipt of services or a one-time payment under
19 this section shall not preclude eligibility for, or receipt
20 of, other assistance or services under this chapter.
