13         Amendment (with title amendment) 

14         On page 16, between lines 25 and 26 of the bill

15

16  insert:

17         Section 18.  Subsections (6) and (7) of section 155.40,

18  Florida Statutes, are added to said section, to read:

19         155.40  Sale or lease of county, district, or municipal

20  hospital.--

21         (6)  Unless otherwise expressly stated in the lease

22  documents, the transaction involving the sale or lease of a

23  hospital shall not be construed as:

24         (a)  a transfer of a governmental function from the

25  county, district, or municipality to the private purchaser or

26  lessee;

27         (b)  constituting a financial interest of the public

28  lessor in the private lessee; or

29         (c)  making a private lessee an integral part of the

30  public lessor's decision-making process.

31         (7)  The lessee of a hospital, pursuant to this section

 1  or any special act of the legislature, operating under a lease

 2  executed prior to July 1, 1993, shall not be construed to be

 3  "acting on behalf of" the lessor as that term is used in

 4  statute, unless the lease document expressly provides to the

 5  contrary.

10         On page 3, lines 2 and 3

11  remove from the title of the bill:  all of said lines

13  and insert in lieu thereof:

14         enumerated in s. 190.012, F.S.; amending s.

15         155.40, F.S.; providing construction with

16         respect to a transaction involving the sale or

17         lease of a public hospital; providing

18         construction with respect to specified hospital

19         lessees; providing an effective date.
