16 insert:
17 Section 28. The Department of Children and Family
18 Services shall contract with the Correctional Privatization
19 Commission created under chapter 957, F.S., from funds
20 contained in the 1999-00 General Appropriations Act for the
21 purpose of creating The Jimmy Ryce Treatment Facility. The
22 commission is directed to develop and issue by September 1,
23 1999, a request for proposals for the financing, designing,
24 constructing, acquiring, owning, leasing, and operating of a
25 treatment facility, to house and rehabilitate individuals
26 committed under the Jimmy Ryce Act of 1998. The commission
27 shall determine the feasibility of using an existing privately
28 owned or state-owned facility prior to the issuance of the
29 request for proposals. If the commission determines that a new
30 facility is necessary, the facility shall be designed with an
31 initial capacity for 450 individuals. The facility shall also

1 be designed with expansion capabilities to serve additional
2 individuals committed under the Jimmy Ryce Act of 1998. The
3 provisions of section 957.07, F.S., and section 957.11, F.S.,
4 shall not apply to this procurement. The commission shall
5 enter into contracts as soon as possible with a provider for
6 the financing, designing, constructing, acquiring, owning,
7 leasing, and operating of the Jimmy Ryce Treatment Facility.
8 The operations contract shall be for an initial period of
9 three years with options to renew. The commission and the
10 Department of Children and Family Services shall enter into an
11 interagency agreement for the commission to provide contract
12 monitoring and auditing of the operation of the facility by
13 the contractor in accordance with standards established by the
14 Department of Children and Family Services. The commission
15 shall invite proposers to present various financing options in
16 their proposals and shall determine which financing mechanism
17 is in the best interests of the state. The selected contractor
18 is authorized to enter into a lease arrangement or other
19 private financing, or to sponsor the issuance of tax exempt
20 bonds, certificates of participation, or other public or
21 private means to finance the project. The state is authorized
22 to enter into all such agreements as are necessary including
23 lease alternatives to bring this project to operational and
24 lease commencement.
