  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Juvenile Welfare Trust Fund within the

  4         Department of Juvenile Justice; providing for

  5         sources of funds and purposes; providing for

  6         annual carryforward of funds; providing for

  7         future review and termination or re-creation of

  8         the trust fund; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  (1)  The Juvenile Welfare Trust Fund is

13  hereby created, to be administered by the Department of

14  Juvenile Justice. The trust fund shall be credited with

15  proceeds from the operation of canteens, vending machines,

16  hobby shops, activity centers, farming projects, donations to

17  a program, contracted telephone commissions, and other such

18  facilities or programs designated as accruing to the trust

19  fund. The purpose of the trust fund shall be for the benefit

20  and welfare of juveniles committed to or detained in

21  facilities operated by the department or by private vendors

22  contracting with the department.

23         (2)  Notwithstanding the provisions of s. 216.301,

24  Florida Statutes, and pursuant to s. 216.351, Florida

25  Statutes, any balance in the trust fund at the end of any

26  fiscal year shall remain in the trust fund at the end of the

27  year and shall be available for carrying out the purposes of

28  the trust fund.

29         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

30  III of the State Constitution, the trust fund shall, unless

31  sooner terminated, be terminated on July 1, 2002. However,

  1  before its scheduled termination, the trust fund must be

  2  reviewed as provided in s. 215.3206(1) and (2), Florida

  3  Statutes.

  4         Section 2.  This act shall take effect upon becoming a

  5  law.
