8 department regarding the system; deleting
9 obsolete provisions; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsections (1) and (3) of section
15 282.1095, Florida Statutes, 1998 Supplement, are amended to
16 read:
17 282.1095 State agency law enforcement radio system.--
18 (1) The Department of Management Services may acquire
19 and implement For the purpose of acquiring and implementing a
20 statewide radio communications system to serve law enforcement
21 units of state agencies, and to serve local law enforcement
22 agencies through a mutual aid channel., The Joint Task Force
23 on State Agency Law Enforcement Communications is established
24 in the Department of Management Services to advise the
25 department of member-agency needs for the planning, designing,
26 and establishment of the joint system. and The State Agency
27 Law Enforcement Radio System Trust Fund is established in the
28 Department of Management Services from July 1, 1988, through
29 December 31, 2003. The trust fund shall be funded from
30 surcharges collected under ss. 320.0802 and 327.25.

1 (3) Upon appropriation, moneys in the trust fund may
2 be used by the department joint task force to acquire by
3 competitive procurement the equipment; software; and
4 engineering, administrative, and maintenance services it needs
5 to construct, operate, and maintain the statewide radio
6 system. Moneys in the trust fund collected as a result of the
7 surcharges set forth in ss. 320.0802 and 327.25 shall be used
8 to help fund the costs of the system. Upon completion of the
9 system, moneys in the trust fund may also be used by the
10 department joint task force to provide for payment of the
11 recurring maintenance costs of the system. Moneys During
12 statewide implementation, moneys in the trust fund may be
13 appropriated used by the joint task force to maintain and
14 enhance, over and above existing agency budgets, existing
15 radio equipment systems of the state agencies represented by
16 the task force members, in an amount not to exceed up to a
17 maximum of 10 percent per year per agency, of the existing
18 radio equipment inventory until the existing radio equipment
19 can be replaced pursuant to implementation of the statewide
20 radio communications system.
21 Section 2. This act shall take effect July 1, 1999.
