  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Juvenile Care and Maintenance Trust Fund within

  4         the Department of Juvenile Justice; providing

  5         sources of funds and purposes; providing for

  6         annual carryforward of funds; providing for

  7         future review and termination or re-creation of

  8         the trust fund; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  (1)  The Juvenile Care and Maintenance

13  Trust Fund is hereby created, to be administered by the

14  Department of Juvenile Justice. The trust fund shall be

15  credited with any money or other property received for

16  personal use or benefit of juveniles in the custody of the

17  department. The purpose of the trust fund shall be for the

18  department to act in a fiduciary capacity on behalf of

19  juveniles committed to or detained in facilities operated by

20  the department or by private vendors contracting with the

21  department.

22         (2)  Notwithstanding the provisions of s. 216.301,

23  Florida Statutes, and pursuant to s. 216.351, Florida

24  Statutes, any balance in the trust fund at the end of any

25  fiscal year shall remain in the trust fund at the end of the

26  year and shall be available for carrying out the purposes of

27  the trust fund.

28         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

29  III of the State Constitution, the trust fund shall, unless

30  sooner terminated, be terminated on July 1, 2002. However,

31  before its scheduled termination, the trust fund must be

  1  reviewed as provided in s. 215.3206(1) and (2), Florida

  2  Statutes.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
