11  The Committee on Comprehensive Planning, Local and Military

12  Affairs recommended the following amendment:

14         Senate Amendment (with title amendment) 

15         On page 2, lines 8-17, delete those lines

16

17  and insert:

18         Section 2.  Metropolitan Dade County is authorized and

19  directed to appropriate the sum of $1,300,000 from funds of

20  the county not otherwise encumbered, to be paid to the Estate

21  of Elionne Joseph as relief for the losses sustained by Ms.

22  Joseph's surviving children.

23         Section 3.  The financial officer of Metropolitan Dade

24  County is directed to draw a warrant in favor of the Estate of

25  Elionne Joseph in the sum of $1,300,000.

 1  and insert:

 2         WHEREAS, prior to trial, the parties reached an

 3  agreement to settle the matter for the total amount of

 4  $1,500,000, and

 5         WHEREAS, on October 9, 1998, the parties entered into a

 6  stipulation of settlement, and

 7         WHEREAS, on November 18, 1998, a consent judgment was

 8  entered approving the stipulation of settlement, and

 9         WHEREAS, Metropolitan Dade County will pay the limit of

10  $200,000 under section 768.28, Florida Statutes, and

11         WHEREAS, Metropolitan Dade County has agreed to support

12  a claim bill for the remaining amount of $1,300,000, under the

13  settlement agreement, NOW, THEREFORE,
