  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         240.5125, F.S.; creating the University of

  4         South Florida Health Support Trust Fund within

  5         the State University System; providing for

  6         sources of funds and purposes; providing for

  7         annual carryforward of funds; providing for

  8         future review and termination or re-creation of

  9         the trust fund; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Section 240.5125, Florida Statutes, is

14  created to read:

15         240.5125  University of South Florida Health Support

16  Trust Fund.--

17         (1)  The University of South Florida Health Support

18  Trust Fund is hereby created, to be administered by the State

19  University System. Funds shall be credited to the trust fund

20  from cigarette tax revenues paid to the Board of Directors of

21  the H. Lee Moffitt Cancer Center and Research Institute as

22  provided in chapter 98-286, Laws of Florida, and from the

23  Tobacco Settlement Trust Fund as provided in chapter 98-307,

24  Laws of Florida. The purpose of the trust fund is to segregate

25  revenues used for constructing, furnishing, and equipping a

26  cancer research facility at the University of South Florida

27  adjacent to the H. Lee Moffitt Cancer Center and Research

28  Institute and for the Healthy Moms and Healthy Babies facility

29  at the University of South Florida.

30         (2)  Notwithstanding the provisions of s. 216.301 and

31  pursuant to s. 216.351, any balance in the trust fund at the

  1  end of any fiscal year shall remain in the trust fund at the

  2  end of the year and shall be available for carrying out the

  3  purposes of the trust fund.

  4         (3)  Pursuant to the provisions of s. 19(f)(2), Art.

  5  III of the State Constitution, the trust fund shall, unless

  6  terminated sooner, be terminated on July 1, 2003. However,

  7  prior to its scheduled termination, the trust fund shall be

  8  reviewed as provided in s. 215.3206(1) and (2).

  9         Section 2.  This act shall take effect July 1, 1999.
