11  Senator Cowin moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 4, between lines 30 and 31,

15

16  insert:

17         Section 4.  Present subsections (2), (3), (4), and (5)

18  of section 367.091, Florida Statutes, are redesignated as

19  subsections (3), (4), (5), and (6), respectively, and a new

20  subsection (2) is added to that section, to read:

21         367.091  Rates, tariffs; new class of service.--

22         (2)  Upon filing an application for new rates, the

23  utility shall mail a copy of the application to the chief

24  executive officer of the governing body of each county within

25  the service areas included in the rate request. The governing

26  body may petition the commission for leave to intervene in the

27  rate change proceeding and the commission shall grant

28  intervenor status to any governing body that files a petition.
