  1                      A bill to be entitled

  2         An act relating to use of municipal

  3         rights-of-way; amending s. 337.401, F.S.;

  4         providing that specified provisions of law

  5         governing the regulation of rights-of-way for

  6         utilities do not apply to the provision of pay

  7         telephone service on municipal roads or

  8         rights-of-way; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (10) is added to section

13  337.401, Florida Statutes, 1998 Supplement, to read:

14         337.401  Use of right-of-way for utilities subject to

15  regulation; permit; fees.--

16         (10)  This section, except subsection (6), does not

17  apply to the provision of pay telephone service on public or

18  municipal roads or rights-of-way.

19         Section 2.  This act shall take effect upon becoming a

20  law.

      Provides that described provisions of law regulating the
