  1                      A bill to be entitled

  2         An act relating to mobile home subdivision

  3         homeowners' associations; creating s. 723.0751,

  4         F.S.; authorizing mobile home lot owners to

  5         participate in mobile home subdivision

  6         homeowners' associations; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 723.0751, Florida Statutes, is

12  created to read:

13         723.0751  Mobile home subdivision homeowners'

14  association.--

15         (1)  If a homeowners' association has not been created

16  under ss. 617.301-617.312 to manage a mobile home subdivision,

17  the owners of lots in the mobile home subdivision are

18  authorized to create a mobile home subdivision homeowners'

19  association in the manner prescribed in ss. 723.075, 723.076,

20  and 723.078 which has the powers, to the extent applicable,

21  set forth in ss. 723.075, 723.077, 723.079 and 617.31.

22         (2)  Rights granted to the owners of lots in a mobile

23  home subdivision by s. 723.002 and otherwise in this chapter

24  may be exercised through an association created or authorized

25  under this section for the owners of lots who are members of

26  the association.

27         (3)  If the owners of lots in a mobile home subdivision

28  share common properties or recreational amenities with the

29  owners of mobile homes in a mobile home park and the mobile

30  home owners have created a mobile homeowners' association

31  under ss. 723.075-723.079, the association is authorized to

  1  represent owners of lots in the mobile home subdivision upon

  2  the following conditions:

  3         (a)  The members of the mobile homeowners' association

  4  in the mobile home park have authorized the membership of the

  5  owners of lots in the mobile home subdivision by a majority

  6  vote of the membership of the association.

  7         (b)  The owners of lots in the mobile home subdivision

  8  are entitled to vote only on matters that affect their rights

  9  as more particularly described in s. 723.002 and otherwise in

10  this chapter and in s. 617.31.

11         Section 2.  This act shall take effect upon becoming a

12  law.

16    Grants a mobile home lot owner the right to participate
      as a member of a mobile home subdivision homeowners'
17    association under certain circumstances.
