2 An act relating to trust funds; creating s.
3 20.3254, F.S.; creating the Grants and
4 Donations Trust Fund within the Fish and
5 Wildlife Conservation Commission; providing for
6 source of moneys and purposes; providing for
7 future review and termination or re-creation of
8 the fund; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 20.3254, Florida Statutes, is
13 created to read:
14 20.3254 Fish and Wildlife Conservation Commission;
15 Grants and Donations Trust Fund.--
16 (1) The Grants and Donations Trust Fund is created
17 within the Fish and Wildlife Conservation Commission. The fund
18 shall serve as the depository for any moneys received by the
19 commission which are not otherwise deposited directly into a
20 separate trust fund, including, but not limited to, federal
21 grants and other grants, receipts, gifts, or donations made to
22 the commission. The trust fund is intended to be a broad-based
23 fund from which moneys may be used for various program
24 purposes of the commission, including purposes for which
25 federal funds were intended.
26 (2) Funds from the trust fund may be expended for
27 purposes related to marine research, marine habitat
28 restoration, aquatic weed control, aquatic life, wild animal
29 life, and marine life.
30 (3) The commission is designated as the administrative
31 agency of the state to apply for and accept any funds or other

1 aid and to cooperate and enter into contracts and agreements
2 with the Federal Government relating to the planning, design,
3 construction, operation, maintenance, and enforcement
4 activities of the commission or to any related federally
5 authorized environmental purpose. The commission may make
6 applications in the name of the state, sign documents, give
7 assurances, and other things necessary to obtain aid from or
8 cooperate with the Federal Government or its agencies.
9 (4) The commission may enter into contracts and
10 agreements and cooperate with any other state agency, local
11 government agency, person, or other state in carrying out its
12 responsibilities with respect to the moneys deposited into and
13 expended from the trust fund created under this section.
14 (5) In accordance with the provisions of s. 19(f)(2),
15 Art. III of the State Constitution, the Grants and Donations
16 Trust Fund shall be terminated on July 1, 2003, unless
17 terminated sooner. Prior to its scheduled termination, the
18 trust fund must be reviewed as provided in s. 215.3206(1) and
19 (2).
20 Section 2. This act shall take effect July 1, 1999,
21 but it shall not take effect unless it is enacted by a
22 three-fifths vote of the membership of each house of the
23 Legislature.
