  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         403.0611, F.S.; creating the Environmental Law

  4         Enforcement Trust Fund within the Department of

  5         Environmental Protection; providing purpose and

  6         source of funds; providing for future review

  7         and termination or re-creation of the trust

  8         fund; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Section 403.0611, Florida Statutes, is

13  created to read:

14         403.0611  Environmental Law Enforcement Trust Fund.--

15         (1)  The Environmental Law Enforcement Trust Fund is

16  created within the Department of Environmental Protection. The

17  purpose of the trust fund is to carry out the department's

18  responsibilities to enforce the provisions of this chapter and

19  chapters 161, 253, 259, 260, 373, and 375 and any other law

20  enforcement duties of the department specified by state or

21  federal law. Deposited into the trust fund shall be such

22  revenues as are appropriated by the Legislature to finance the

23  performance of the department's law enforcement

24  responsibilities.

25         (2)  Pursuant to the provisions of s. 19(f)(2), Art.

26  III of the State Constitution, the trust fund shall, unless

27  terminated sooner, be terminated on July 1, 2003. However,

28  before its scheduled termination, the trust fund shall be

29  reviewed as provided in s. 215.3206(1) and (2).

30         Section 2.  This act shall take effect July 1, 1999.
